Pemerintah Resmi Berlakukan KUHAP Baru, Dari Restorative Justice hingga Soal Rekaman CCTV<\/h1>\n

JAKARTA, Nawacita<\/a><\/strong> – Pemerintah Resmi Berlakukan KUHAP Baru, Pemerintah Republik Indonesia mulai memberlakukan secara efektif Undang-Undang Nomor 20 Tahun 2025 tentang Kitab Undang-Undang Hukum Acara Pidana atau KUHAP, Jumat.<\/p>\n

Dalam salinan undang-undang yang diterima di Jakarta, KUHAP baru ini memperkenalkan sejumlah mekanisme hukum terbaru, termasuk keadilan restoratif, jalur khusus pengakuan bersalah, hingga kewajiban perekaman pemeriksaan menggunakan kamera pengawas.<\/p>\n

Pemberlakuan undang-undang ini menandai berakhirnya era KUHAP lama (UU Nomor 8 Tahun 1981) yang menggeser sistem peradilan pidana Indonesia dari yang bersifat menghukum (punitive) menjadi pemulihan (restorative).<\/p>\n

Salah satu poin penting dalam regulasi setebal 238 halaman ini adalah pengakuan legal terhadap keadilan restoratif (restorative justice) sebagaimana tertuang pada pasal 79 hingga pasal 88.<\/p>\n

Mekanisme ini memungkinkan penyelesaian perkara di luar pengadilan dengan tujuan memulihkan keadaan semula, yang melibatkan korban dan pelaku.<\/p>\n

Undang-undang secara tegas membatasi bahwa keadilan restoratif tidak berlaku untuk tindak pidana berat seperti terorisme, korupsi, kekerasan seksual, serta tindak pidana terhadap nyawa orang.<\/p>\n

Selain itu, KUHAP baru ini juga memberikan kewenangan kepada majelis hakim untuk menjatuhkan “Putusan Pemaafan Hakim”.<\/p>\n

“Hakim dapat menyatakan seorang terdakwa terbukti bersalah tetapi tidak menjatuhkan pidana atau tindakan apa pun dengan mempertimbangkan ringannya perbuatan, keadaan pribadi pelaku, serta aspek kemanusiaan dan keadilan,” petikan pasal 246.<\/p>\n

Guna mengatasi penumpukan perkara, UU Nomor 20 Tahun 2025 memperkenalkan mekanisme Pengakuan Bersalah yang tercantum pada pasal 78.<\/p>\n

Jalur ini dapat ditempuh oleh terdakwa yang baru pertama kali melakukan tindak pidana dengan ancaman penjara paling lama 5 tahun.<\/p>\n

Jika terdakwa mengakui kesalahannya dan bersedia membayar ganti rugi atau restitusi, proses persidangan dapat dilakukan dengan acara pemeriksaan singkat dan terdakwa berpotensi mendapatkan keringanan hukuman.<\/p>\n

Dalam upaya memperkuat perlindungan hak asasi manusia (HAM) dan mencegah penyiksaan, pasal 30 undang-undang ini mewajibkan pemeriksaan terhadap tersangka direkam menggunakan kamera pengawas (CCTV) selama proses berlangsung.<\/p>\n

“Pemeriksaan terhadap seseorang yang disangka melakukan tindak pidana direkam dengan menggunakan kamera pengawas selama pemeriksaan berlangsung,” petikan ayat 1 pasal 30.<\/p>\n

Pada ayat 2 disebutkan bahwa rekaman tersebut diakui sebagai alat untuk kepentingan pembelaan tersangka di sidang pengadilan.<\/p>\n

Undang-undang ini juga mengakomodasi perkembangan teknologi dengan melegalkan penyelenggaraan peradilan pidana berbasis teknologi informasi (SPPT-TI), mulai dari tahap penyelidikan hingga pemasyarakatan.<\/p>\n

Dengan berlakunya UU Nomor 20 Tahun 2025 ini, seluruh ketentuan dalam UU Nomor 8 Tahun 1981 dinyatakan dicabut dan tidak berlaku lagi, meskipun peraturan pelaksanaannya masih tetap berlaku sepanjang tidak bertentangan dengan undang-undang baru ini.<\/p>\n

Pemerintah Indonesia secara resmi memberlakukan KUHAP yang baru per 2 Januari 2026, bersamaan dengan implementasi KUHP Nasional.<\/p>\n

Regulasi ini telah ditandatangani Presiden Prabowo Subianto di Jakarta pada 17 Desember 2025, setelah mendapat pengesahan dari DPR RI.<\/p>\n
