Perkara itu masuk ke MK dengan nomor 90\/PUU-XXI\/2023.<\/p>\n<p>&#8220;Mengadili mengabulkan permohonan pemohon untuk sebagian,&#8221; kata Ketua MK\u00a0Anwar Usman\u00a0dalam sidang pengucapan putusan di Gedung MK pada Senin (16\/10\/2023).<\/p>\n<p>MK menyatakan Pasal 169 huruf q UU Pemilu yang menyatakan &#8220;berusia paling rendah 40 tahun&#8221; bertentangan dengan UUD 1945 dan tidak mempunyai kekuatan hukum mengikat.<\/p>\n<p>&#8220;Sehingga pasal 169 huruf q selengkapnya berbunyi &#8216;berusia paling rendah 40 tahun atau pernah\/sedang menduduki jabatan yang dipilih melalui pemilihan umum termasuk pemilihan kepala daerah&#8217;,&#8221; ujar Anwar yang juga adik ipar Presiden Joko Widodo ini.<\/p>\n<p><strong>Baca Juga:\u00a0<a href=\"https:\/\/nawacita.co\/index.php\/2023\/10\/16\/mk-tolak-gugatan-psi-soal-batas-usia-capres-cawapres\/\">MK Tolak Gugatan PSI Soal Batas Usia Capres-Cawapres<\/a><\/strong><\/p>\n<p>Atas putusan ini, dua hakim MK menyatakan\u00a0<em>occuring opinion<\/em>\u00a0atau alasan berbeda yaitu Enny Nurbaningsih dan Daniel Yusmic. Lalu ada pula empat pendapat berbeda atau\u00a0<em>dissenting opinion<\/em>\u00a0dari Wahiduddin Adams, Saldi Isra, Arief Hidayat, Suhartoyo.<\/p>\n<p>Melalui keputusan MK ini, putra sulung Presiden Jokowi, Gibran Rakabuming Raka memiliki kesempatan untuk menjadi bakal calon presiden atau calon wakil presiden. Gibran saat ini sedang menduduki jabatan Wali Kota Solo.<\/p>\n<p>Banyak pihak yang menuding, gugatan terhadap syarat usia capres-cawapres ini untuk memberi jalan bagi Gibran untuk menjadi bakal cawapres di Pilpres 2024.
